Please read these Terms of Service carefully before using Perspectra.
These Terms of Service ("Terms") govern your access to and use of the website at https://perspectra.org/ and the Perspectra service (collectively, the "Services"), operated by Dillon Webster ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
1. The Service
Perspectra is an AI-powered news analysis tool. You can submit news articles or browse curated headlines, and the Services use artificial intelligence to generate summaries, multiple perspectives, and analysis. Registered users can create an account to save articles and analyses.
The Services are provided for informational purposes only. They do not constitute, and should not be relied upon as, professional, legal, financial, medical, or any other form of advice.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Accounts
To access certain features, you may need to create an account. When you do, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your account information;
- Keep your login credentials confidential and secure; and
- Accept responsibility for all activity that occurs under your account.
We use a third-party authentication provider to manage sign-in. You are responsible for any activity under your account, whether or not you authorized it. Notify us immediately at [email protected] if you suspect any unauthorized use of your account.
4. AI-Generated Content and Accuracy
The Services use artificial intelligence, including third-party AI providers, to generate summaries, perspectives, and analysis ("AI Output"). You understand and agree that:
- AI Output may be inaccurate, incomplete, biased, or outdated, and may not reflect the full context of the underlying source material;
- AI Output is generated automatically and does not represent our views or opinions;
- You should independently verify any information before relying on it; and
- We do not guarantee the accuracy, reliability, completeness, or usefulness of any AI Output or other content available through the Services.
You are solely responsible for any decisions or actions you take based on AI Output or other content from the Services.
5. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation, or infringe the rights of any third party;
- Submit content that you do not have the right to submit, or that is unlawful, defamatory, or harmful;
- Attempt to gain unauthorized access to the Services, other accounts, or our systems or networks;
- Interfere with, disrupt, or place an unreasonable load on the Services or their infrastructure;
- Use any automated means (such as bots or scrapers) to access the Services in a manner that violates these Terms or exceeds reasonable use;
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except as permitted by law;
- Use the Services to develop a competing product or to train competing machine learning models; or
- Use the Services in any way that violates the terms or policies of our third-party AI providers.
We reserve the right to investigate and take appropriate action, including suspending or terminating your access, for any violation of these Terms.
6. Third-Party Content and Links
The Services may display, link to, or analyze content from third-party sources, including news articles and websites. We do not own, control, endorse, or assume responsibility for any third-party content. Your use of third-party content and websites is at your own risk and may be subject to the terms and policies of those third parties.
7. Intellectual Property
The Services, including all software, design, text, graphics, and other materials we provide (excluding third-party and user-submitted content), are owned by us or our licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
You retain any rights you have in the content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display that content as necessary to operate and provide the Services to you. You represent and warrant that you have the necessary rights to submit any content you provide and that doing so does not violate the rights of any third party.
8. Copyright and DMCA
We respect the intellectual property rights of others. Perspectra provides original analysis and commentary and displays limited excerpts and links to source material; copyright in the underlying articles remains with their respective owners. If you believe content available through the Services infringes your copyright, please review our Copyright & DMCA Policy for instructions on submitting a takedown notice. We will respond to valid notices and may, in appropriate circumstances, terminate the accounts of repeat infringers.
9. Subscriptions and Fees
Certain features of the Services may be offered on a free or paid basis, subject to usage limits that we may set and change at our discretion. If we introduce paid features, the applicable pricing, billing, and cancellation terms will be presented to you at the point of purchase and are incorporated into these Terms by reference.
10. Disclaimers
THE SERVICES AND ALL CONTENT, INCLUDING AI OUTPUT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT OR AI OUTPUT WILL BE ACCURATE OR RELIABLE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services, your content, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Services and delete your account at any time. Upon termination, the provisions of these Terms that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
14. Changes to the Services and Terms
We may modify or discontinue the Services, in whole or in part, at any time. We may also update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of these Terms. If we make material changes, we may notify you by posting a notice within the Services or by other reasonable means. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Utah, except where prohibited by applicable law.
16. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. You may not assign these Terms without our prior written consent; we may assign them without restriction.
